The courts are also significant source of law but the impact of this source has been reducing as increasingly more statutes have been passed at the Commonwealth and the state level. However, the courts are frequently required to decide differences where unclear language is used in a particular statute is not clear and needs explaining. All these statutes are written by using a general language that requires specific context. However in some cases, the language used in the statute could be unclear or ambiguous and therefore may have several meanings. In such a case, the statutory interpretation of the particular provision by the courts decides the meaning of the specific clause or the provision. While integrating these statutes, the courts have to keep in mind the provisions of the Acts Interpretation Acts at the federal, state and territory levels. The legislations define several common terms and they also provide that the courts to keep in mind the fundamental purpose of the law. In this regard, however the courts are also allowed to consider extrinsic materials like explanatory memoranda where a doubt is present regarding the meaning that can be attributed to the language used in the statute (Blackshield and Williams, 2006). As mentioned above, a key source of law in Australia is legislation, both at the federal and the state of the territory levels. In view of the bulk of legislation and the pressure that is present on the time of the Parliament, it is not desirable or possible that the parliaments should make decisions related with the details of this legislation. It is particularly the case when the subject matter of a particular legislation is quite technical or it is likely to change frequently. Therefore in this type of cases, power has been provided to the Parliament to 'delegate' or to give away the task of making comprehensive regulations to a subsidiary body (Lane, 1979). Generally this subordinate body is the Governor General or the Governor, a minister of the concerned department who has the responsibility of implementing the legislation or local counsel or any other statutory body. Until then, these bodies may rely on the skill of the experts while creating the regulations that are made acco rding to the Act of the Parliament or in other words the 'enabling' statute. Due to the reason that the subordinate or delegated legislation is made under the authority of the enabling Act, it is required that the rules should be made according to the manner that has been stated by the enabling Act and should fulfill all the formalities (Kercher, 1995). There are numerous mechanisms to ensure that the delegated legislation has been made properly, according to the authority that has been conferred by the Parliament. Delegated legislation can also be reviewed by the courts and they may arrive at the conclusion that the legislation is invalid due to the following reasons. Ultra vires: this happens when the court considers that the delegated legislation extends the power of the authority provided by the enabling Act. In order to establish Ultra vires, it is required be shown that the subordinate legislation is not consistent with the statute law or the common law. The reason is that unless special provisions have been made for delegated legislation to prevail, ge nerally it does not overrule the common law or statute law (Parkinson, 2001). If a court has declared a regulation as ultra vires, the legislation becomes invalid and no longer contains the force of law. Another reason is the lack of formalities. This happens when although the legislation was inside the powers of the subordinate body, however certain formalities have not been fulfilled. The court may declare the legislation to be invalid where, e.g., failure has taken place to follow the compulsory procedure or an attempt has been made to sub-delegate the authority to third-party. The common law is also a source of law which is mainly derived from the verdicts of the judges. As a result, the source of law is also known as the judge made law. Another source of law is the doctrine of precedent. In this context, precedent means the ruling delivered by a court establishing a point of law. The basis of the doctrine of precedent is a notion according to which like cases should be decided alike. Methods: To begin this experiment an individual was asked to squeeze a clothespin as many times as possible within one minute and the results were recorded. Then this same individual was asked to exercise (run in place, preferably) vigorously for 45 seconds. After this period of exercise the same individual squeezed the clothespin as many times as possible within one minute and the results were recorded. At least 10 minutes later, a second trial was completed using the same exact steps, also recording data. These steps were done with 4 subjects separately. In this experiment the independent variable was the prior exercise and the dependent variable was the amount of times the clothespin was squeezed. The constants in this experiment included the amount of exercise, the time allotted to each individual to squeeze the clothespin and similar clothespins. Suggestions for improvement: Despite being a superficially simple experiment, there were many potential sources of error present in conducting the experiment. The largest and most prevalent source of error was the counting of how many times the clothespin was squeezed in a minute. Even with the help of other group members, it was very difficult to count the number of times the clothespin was squeezed especially because it was averaging around 250 squeezes in a minute. Also as the clothespin was used more and more, it became worn down and perhaps became easier to squeeze, thus resulting in more squeezes after exercise. Some other confounding variables included the amount of exercise. If one of the individuals exercised with more determination or even with more force, it would be more likely to get their heart rate higher. Also some individuals may have eaten more energy efficient food and had gained more energy than other individuals. Another significant variable was the kind of exercise. If the type of exercise involved any of the muscles used in squeezing the clothespin, then it would be extremely detrimental to the results of the experiment. The goal of the exercise is not to tire out the muscles but rather to get the heart rate up. In a controlled laboratory there are several ways to prevent these errors and confounding variables. In order to count the clothespin squeezes accurately, one may attach a high tech counting device. This would greatly improve results. Also if there were a controlled exercise that involved none of the muscles used in the experiment it would eliminate several errors and confounding variables. Also to decrease error overall, increasing sample size would have a substantial effect. Suggestions for further research: During this experiment several questions were left unanswered and provided suggestions for further research. One of these questions was if increased squeezing of the clothespin was correlated with an increase in heart rate in general. To test this one would have to test different ways of getting someone’s heart rate up such as exercise, scaring, and making them nervous, then make sure that the heart rates are the same, and finally test if the increased heart rate overall allows that individual to squeeze the clothespin more, or if it is just after exercise. Another question that was left unanswered was whether a repetition of squeezing the clothespin over a series of months causes the individual to squeeze the clothespin more. To test this one would have to have a large amount of people squeeze clothespins for an allotted time every day for a month, or so. Then the tester would collect all the data and see whether there was an increase in the number of times the individuals were able to squeeze the clothespin within the allotted time.

And, ceramic artifacts, unlike stone tools, are completely person-made, shaped of clay and purposely fired. Clay figurines are known from the earliest human occupations; but clay vessels, pottery vessels used for storing, cooking and serving food, and carrying water were first manufactured in China at least 20,000 years ago. Yuchanyan and Xianrendong Caves Recently redated ceramic sherds from the Paleolithic/Neolithic cave site of Xianrendong in the Yangtse Basin of central China in Jiangxi province hold the earliest established dates, at 19,200-20,900 cal BP years ago. These pots were bag-shaped and coarse-pasted, made of local clay with inclusions of quartz and feldspar, with plain or simply decorated walls. The second oldest pottery in the world is from Hunan Province, at the karst cave of Yuchanyan. In sediments dated between 15,430 and 18,300 calendar years before the present (cal BP) were found sherds from at least two pots. One was partially constructed, and it was a wide-mouthed jar with a pointed bottom that looks very much like the Incipient Jomon pot illustrated in the photograph and about 5,000 years younger. The Yuchanyan sherds are thick (up to 2 cm) and coarsely pasted, and decorated with cord-marks on the interior and exterior walls. The Kamino Site in Japan The next earliest sherds are from the Kamino site in southwestern Japan. This site has a stone tool assemblage which appears to classify it as late Paleolithic, called Pre-ceramic in Japanese archaeology to separate it from the Lower Paleolithic cultures of Europe and the mainland. At the Kamino site in addition to a handful of potsherds were found micro blades, wedge-shaped microcores, spearheads and other artifacts similar to assemblages at Pre-ceramic sites in Japan dated between 14,000 and 16,000 years before the present (BP). This layer is stratigraphically below a securely dated Initial Jomon culture occupation of 12,000 BP. The ceramic sherds are not decorated and are very small and fragmentary. Recent thermoluminescence dating of the sherds themselves returned a 13,000-12,000 BP date. Jomon Culture Sites Ceramic sherds are also found, also in small quantities, but with a bean-impression decoration, in a half-dozen sites of the Mikoshiba-Chojukado sites of southwestern Japan, also dated to the late Pre-ceramic period. These pots are bag-shaped but somewhat pointed at the bottom, and sites with these sherds include the Odaiyamamoto and Ushirono sites, and Senpukuji Cave. Like those of the Kamino site, these sherds are also quite rare, suggesting that although the technology was known to the Late Pre-ceramic cultures, it just was not terribly useful to their nomadic lifestyle. In contrast, ceramics were very useful indeed to the Jomon peoples. In Japanese, the word Jomon means cord-mark, as in cord-marked decoration on pottery. The Jomon tradition is the name given to hunter-gatherer cultures in Japan from about 13,000 to 2500 BP, when migrating populations from the mainland brought full-time wet rice agriculture. For the entire ten millennia, the Jomon peoples used ceramic vessels for storage and cooking. Incipient Jomon ceramics are identified by patterns of lines applied onto a bag-shaped vessel. Later, as on the mainland, highly decorated vessels were also manufactured by the Jomon peoples. By 10,000 BP, the use of ceramics is found throughout mainland China, and by 5,000 BP ceramic vessels are found throughout the world, both independently invented in the Americas or spread by diffusion into the middle eastern Neolithic cultures. Porcelain and High-Fired Ceramics The first high-fired glazed ceramics were produced in China, during the  Shang  (1700-1027 BC) dynasty period. At sites such as Yinxu and Erligang, high-fired ceramics appear in the 13th-17th centuries BC. These pots were made from a local clay, washed with wood ash and fired in kilns to temperatures of between 1200 and 1225 degrees Centigrade to produce a high fired lime-based glaze. Shang and Zhou dynasty potters continued to refine the technique, testing different clays and washes, eventually leading to the development of true porcelain. See Yin, Rehren and Zheng 2011. Management theories in social care: Management theory is a widespread term which is used lightly to refer to research discoveries, frameworks, propositions, beliefs, views, saws and suggestions, all of which seek to describe how managers should manage. There are a number of theories about managing service delivery in social care. Some of them are Bureaucracy theory, scientific management theory, Administrative theory, Human relations theory, Neo-human relations theory and Guru Theory, etc. Max Webers theory of bureaucracy was established in a historical- philosophical context. His interests were in the process of social modification, and in particular, in the effect of rationality on religious thought and capitalism. By rationality he meant the kind of action or mode of organizing in which goals are clearly conceived and all conduct, except that designated to reach the specific goal, is rejected. The application of his idea of rationality to the organizational context is what secured this social scientists pre- eminent location in modern management thought. The term that Weber applied to the organizational form built upon pure legal- rational authority was bureaucracy. The Weber and model of bureaucracy gives a steady and predictable world which supplies the blueprint for rational designed structures in which rational individuals carry out their roles and actions. For Weber, the bureaucratic form of organization possessed the features of specialization, hierarchy, rule s, impersonality, full- time officials, career focus and a split between public and private activity. Developed at the starting of the twentieth century, Frederick Winslow Taylors theory of scientific management focused upon shop floor organization, and upon the methods that could be used to exploit the productivity of manual workers. Scientific management principals such as a perfect division of task and responsibilities between management and workers, scientific choice and training of workers, development of the one- best- way of working, and the application of financial incentives, all remain to be used to this day. The primary focus of administrative theory was on the determination of which types of specialization and hierarchy would enhance the efficiency of organizations. The theory is constructed around the four central pillars- the division of labor, the scalar and useful processes organizational structure, and the span- of- control. The role of managing service delivery in social care: Managers in social work want to have several talents. Some of them are good vision which is informed by connecting service users and other partners, ability to lead and support staff to work with service users and their careers to influence service development and outcomes, take responsibility and be accountable for good training, ability to influence a wide range of stakeholders to promote a social model of care and its values and they should be able to deal with the conflicts, pressures, and gate- keeping roles in managing social work services, taking account of individual and community heeds. Frameworks for delivery in social care: A framework for leadership and management progress wants to be broad in its scope given the breadth of change that is already taking place across social work services and the demands this creates for effective leadership and management. The framework should therefore address the following areas, professional and practice management, political management, strategic management, operational management, academic management and citizen management. Implementation of management in social care: Evaluation of the outline for leadership and management development as it is implemented is also recommended to ensure that it reaches the goals identified, meets the identified needs and that it continues to be relevant. Evaluation will be dangerous to understanding what is successful and where blockages happen. This will assist in identifying what additional action is wanted to ensure empowering and enabling leadership and effective management is in place to deliver improved results for users and careers. Challenges of managing service delivery in social care: A major challenge for leadership and management across social work services is one of change management. To deliver the vision set out in the 21st century social work review needs transforming how we think about services, how we deliver those services and a shared view of what the changes we are seeking to make should deliver. Beginning the right culture and climate for change to implement the review successfully is critical to its achievement.
